Within the Manufacturers Warranty

The present warranty is offered by Tecna group s.r.l. ( also named Tecna) “in compliance to the law D.lgs. n.206 dated 06/09/2005 with reference to the “Manufacturers Warranty”, and has a validity of 12 months from the day of the delivery and it is referred to a daily use of 8 hours for a maximum of 1600 hours,
1)The product is to be considered defective when it does not offer the safety that is legitimately expected in consideration of all the circumstances within which:-
• The way that the product has been set to operate , its’ characteristics , the respect of its instructions and all the warnings given;
• The use to which the product can be destined and the behaviours that, in relationship to it, can be reasonably foreseen;
• The product cannot be considered defective for the only fact that a more improved product, in whatever time, has been put in commerce.
2)The guarantee includes the repair and /or the substitution of parts of ordinary functionality of which the presence of defects is shown in the material or in their manufacturing. The shipping costs to Tecna or to the authorized repair centre are not included. Other costs not related to breakers, as rental of other machines, penalty etc.
In relation to this Tecna srl reserves the exclusive right, to verify and to check the considered defective parts.
If from the result of the above said verification and control, by unquestionable judgment of Tecna srl, who recognizes the presence of defective parts, Tecna will carry out the necessary and opportune interventions to repair or substitute the defected parts without additional costs for the client
The faulty considered parts must be delivered complete of all components, in order to be able to carry out all tests and checks, freight paid to TECNA works, within 10 days from the warranty claim.
If in replacing the defective claimed parts , further interventions will be carried out or also parts replaced, at the request of the customer, these parts and work carried out are not to be consider as interventions under warranty , therefore, will be invoiced according to the current prices at the moment of the intervention and/or of the replacement.
3) The repairs or the replacements under warranty cannot exceed the period of 1600 hour validity. It is not possible to activate, without cost for the buyer, a new warrantee period. ( READ below )

EXCEPTIONS CONCERNING THE PERFORMANCES OF GUARANTEE OF THE MANUFACTURER:

The following cases are not included in the performances of Guarantee Of The Manufacturer:
1)Damages due to:
• Non-respect of the instructions mentioned on the user’s manual supplied to the user;
• Interventions by not authorized third parties;
• Bad use;
• Not authorised modifications;
• Operating over the maximum admissible technical specifications indicated on the operator’s manual;
• Faults of the customer or of third parties;
• Forces major and/or fortuitous case, natural catastrophes, etc.;
2) The operations of cleanliness and/or maintenance;
3) The wear parts subject to usury.( please ask for a complete lists of wear part)

EXCLUSIONS OF RESPONSIBILITY

The guarantee is excluded if:
A) the possible fault is due to the conformity of the product to an imperative juridical rule or a binding provision of some authority.
B) if the state of the scientific knowledge and techniques, at the moment of the sale, was not allowing to consider the product as defective.
(C) in the case that it is a defect of a part or better of the raw material, if the fault is entirely due to the conception of the product which the part has been incorporated or that is the raw material or given the conformity of this to the instructions given by Tecna srl.
The guarantee is not extended to those parts considered important as:
•The Seals,
•the pipes
•the diaphragm
•the case
•the mounting plate
• the manometers and other instruments to measure;
•Equipment for nitrogen charging;
•Shock-absorbers;
•Bushes and Retaining axles;
•Tools and other parts subject to wear;
•All the worn-out parts, broken or damaged because of lack of maintenance, improper use or imperfect.
The guarantee is, also, excluded in the following cases:
•if the closing of the hydraulic circuit of the excavator is not correct;
•the temperature of the oil must not exceed the 80° C;
•the oil has not been filtered from a suitable filtering circuit;
•exceeding the flow range limits indicated and allowed on the technical specifications;
•the setting of safety valve of the hydraulic circuit has been tampered with or differently set;
•if the pressure of the hammer exceeds the values show on the technical specification;
•if, non-original parts have been used, during operations;
•if the type of work which the hammer has been designated for has not been reported at the right moment;
•if the customer does not respect the credit terms foreseen by the contract;
•if the guarantee certificate, duly filled in and signed, is not delivered to the Tecna srl. O TECNA Group.

ACCEPTANCE OF THE GUARANTEE CONDITIONS BY THE CUSTOMER
Using the breaker, assumes the value of acceptance of warranty conditions, above described.

EXTENDED WARRANTY PERIOD.
It is possible to activate, a new warrantee period up to two times within 3 months of the expiring of standard warranty.
In order to activate a new warranty period is mandatory to buy and mount a maintenance kit .
Maintenance kit must be mounted by Tecna or by authorized service centre.
The guarantee is not extended in case of self-mounted maintenance kit.
In order to extend the warranty period, service kit must be ordered with indication of the serial number and warranty extension sheet enclosed in the service kit must be sent to Tecna using email at info@tecnanoline.com

PARTS NOT COVERED BY WARRANTY
Eventual point/tools and or pipes delivered by Tecna are to be considered given as free samples and therefore are not subject to warranty claims. The list of the considered wear replacements parts is available to who makes explicit request .

GUARANTEE ON THE REPAIRED PARTS
On the parts recognized defective to unquestionable judgment of the TECNA srl, on which Tecna has carried out the repair job this means, has replaced the component, the guarantee is extended for a 3-month period.

EXERCISE OF THE RIGHT OF RETENTION
If the customer has not respected the foreseen payment obligations, the TECNA Group srl, after executing the commissioned intervention in guarantee, correctly and according to the contractual terms, will be able to its unquestionable judgement, exercise the right to hold and keep the good, until everything owed and due is paid.
